1. WHO MAY USE THE SERVICES

You may use the Services only if you agree to form a binding contract with The Lucid Guide and are not a person barred from receiving services under the laws of the applicable jurisdiction.

For the safety of our users and for fraud and spam prevention, Virtual Private Networks (VPNs) or other services used primarily to obscure or hide a user's identity are blocked from using this site and our community. Attempts to circumvent these restrictions will result in a permanent site ban.

If you upload any user content to your User Account or post it on the Forum, you do so at your own risk. Your access to and use of the Services or any Content are at your own risk. You understand and agree that the Services are provided to you on an “AS IS” and “AS AVAILABLE” basis. The “Lucid Guide Entities” refers to The Lucid Guide, its parents, affiliates, related companies, officers, directors, employees, agents, representatives, partners, and licensors.
 

5.2. UK Consumer Rights
 

As a consumer, nothing in these Terms affects your legal rights under the Consumer Rights Act 2015 (CRA 2015). This includes that any digital content or services we supply must be (i) of satisfactory quality, (ii) fit for purpose, and (iii) as described. We provide no other express or implied warranties beyond those required by the CRA 2015.
 

6. LIMITATION OF LIABILITY 
 

6.1. Non-Excludable Liability 

Nothing in these Terms shall exclude or limit The Lucid Guide's liability for:
 

• Death or personal injury caused by our negligence.

• Fraud or fraudulent misrepresentation.

• Any liability that cannot be excluded or limited under the Consumer Rights Act 2015 or the laws of England and Wales.
   

6.2. General Limitation
 

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LUCID GUIDE ENTITIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
 

6.3. Liability Cap 
 

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE LUCID GUIDE ENTITIES EXCEED THE GREATER OF ONE HUNDRED POUNDS STERLING (£100.00) OR THE AMOUNT YOU PAID THE LUCID GUIDE, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM. The limitations of this subsection shall apply to any theory of liability, whether based on warranty, contract, statute, tort (including negligence) or otherwise.
 

7. GOVERNING LAW AND JURISDICTION 
 

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
 

You and The Lucid Guide irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.
 

8. CHANGES TO THE TERMS
 

We reserve the right to remove Content that violates the User Agreement or these Terms. We may update these Terms from time to time to reflect changes to our services or for legal reasons. The most current version of the Terms will always be on this page.
